Most people want to pay back their creditors. This is sort of ingrained in us, and we understand that mentality. However, we have to be realistic and the law says that you are more important than the people you owe money to. Typically we will start with you, your family, your income, your expenses, your health and the health of your family, your basic needs, and then we ask, “what is left?” Most creditors want you to put them first, but that is backwards and we are here to help you prioritize.
If your budget only allows you to meet your basic needs, or maybe even less, then you will probably benefit with a Chapter 7 Bankruptcy, which is a bankruptcy that wipes out or removes most of your debts. This is best if you just can’t afford repayment and are doing without things that you need most. If you can afford some type of repayment but under different terms, or are maybe trying to save a house from mortgage foreclosure or a car from repossession, then maybe Chapter 13 Bankruptcy is best for you.
